Council Approves Annexation of 5.01 Acres Along South Main Street

Council voted unanimously Wednesday night to approve the annexation of the 5.01 acres owned by Mill District LLC along South Main Street near the Village Service Department.  

However, an issue remains as to what zoning will apply to the property. Suburban Business District (SBD) zoning was discussed, but a problem with that zoning category is that Mill District LLC wants restaurants to be a “permitted” use, while SDB zoning makes restaurants a “conditional” use. [See paragraph D.10. of the Annexation Agreement]. As a “conditional” use, a restaurant would have to show certain stated conditions have been met before receiving Village approval, while a “permitted” use would allow restaurants on the property with no restaurant use-specific approval.

Some discussion ensued about putting the property under the new Gateway District zoning, which could be a controversial move. In the end, Council decided to forgo the decision about zoning until a later date.
